Here at Steve Morris Engines, we pride ourselves on providing engine packages and components that are tried, tested and reliable. In fact, we've built our reputation on helping people go very fast, very reliably. 

All that being said, there are many variables that contribute to engine and component reliability once it leaves our shop. It's no secret that these components get pushed hard! Things like installation configuration, tuning and setup adjustments, and how an engine and it's components are driven contribute to the reliability of an engine. 

We make every effort to take great care of our customers and are confident that we are always more than fair. However, because of those variables, the intended use of these products, and the conditions to which these products are exposed, we are not able to offer warranties or guarantees (performance, reliability or otherwise) on our engines or parts. In addition to our custom components, we typically include components from individual third-party / OEM manufacturers which may have OEM-provided warranties. If warranty services are required on these individual components, then the end-user is responsible to work directly with the third-party OEM suppliers to resolved any issues.

Warranty and Legal Information

Each SME engine, part or assembly is sold “as is”, “where is”, “with all faults”, and without any express guarantees or warranties whatsoever. To the greatest extent permitted by state and federal law, SME disclaims all express and implied warranties including, without limitation, the warranties of merchantability and fitness for a particular purpose; regardless if a particular purpose is identified in association with the SME engine and or part including, without limitation, any sales literature or as a result of representations made by SME or any party selling or providing SME engine and or parts. SME expressly disclaims all liability for direct, indirect, special incidental, punitive, or consequential damages (regardless if SME has been notified of the possibility of such damage), including, without limitation, injury to persons including death; damage to or loss of property or equipment; cost of labor; loss of profits, winnings or revenue; cost of purchase, cost of substitute products or replacement of goods; the cost of SME engine and or parts or any vehicle components or parts affected by the SME engine and or parts; down time costs; claims of buyer’s end users for such damages that were in any way derived or resulted from the recommendation, installation or use of SME engine and or parts. Because race vehicle manufacturing, preparation and testing, and high performance vehicles in general, are inherently dangerous activities that may cause serious bodily injury and/or death to those who use such products and/or participate in such activities, in no event shall SME’s liability, whether if arising in tort (including negligence or strict liability), contract or otherwise exceed the cost of the SME engine and or part. If a SME engine and or part proves defective following its purchase, the buyer and not SME, the manufacturer, distributor, or retailer shall be solely responsible for all costs incurred to service or repair the defective SME engine and or part. The end-user is solely responsible and assumes all risks associated with the performance of the engine and or part. No SME engine and or part is certified under federal motor vehicle safety standards or regulations. Therefore, SME engines and or parts are not certified for use on public roads.

 GOVERNING LAW

These SME Consumer Terms and Conditions of Sale, and all sales of Products and or services by SME to consumers, shall be governed by the laws of the State of Michigan. Any litigation which may be deemed necessary on behalf of either party involved must and will be filed in either in Muskegon County, Michigan or in U.S. District Court for the Western District of Michigan.

 

IMPORTANT NOTICE – EMISSIONS AND OTHER REQUIREMENTS

Federal, state or local laws, rules and regulations in the U.S. or elsewhere may prohibit the removal or modification of components that were installed on motor vehicles or engines by the original equipment manufacturer in order to meet emissions requirements or to comply with safety regulations applicable to engines or vehicles manufactured for use on public roads. Removal of such components may be illegal and considered to be emissions-related tampering under applicable laws, rules and regulations.  Compliance with such laws, rules and regulations are the obligation of the purchaser or vehicle owner. SME disclaims any and all responsibility.
